Gordon's emphasizes that the process of prosecution is crucial to the idea of crime. One who commits a public wrong is properly called to public account for it, and the criminal trial constitutes such a public calling to account. The state is the proper prosecutor of crimes: since a crime is ‘our’ wrong, rather than only the victim's wrong, it is appropriate that we should prosecute it, collectively. The case is not simply V the victim, or P the plaintiff, against (...) D the defendant. It is brought, as the Americans properly have it, by ‘the People’, or by ‘the Commonwealth’, against the defendant. This is a useful way in which to think about crimes and criminalisation. This chapter tries to develop this conception of public wrongs a little further, which also involves complicating it more than a little. It works from a version of liberal communitarianism that rejects the metaphysical version of the individualist's ‘unencumbered self’; but the account sketched here should be compatible with all but the most radically individualist kinds of liberal theory. One of the central critiques of the bourgeois conception of public holds that, in its implicit claim to universality, it fails to account for the material particularities of social groups and for the variety of possible rationalities. Some theorists have aimed to solve this problem by describing particular publics and particular rationalities based on racial, ethnic, gender, or political identities. While particularist public models represent difference in protest of the totalizing and counterfactual valence of a bourgeois conceptualization of public, they (...) fail to acknowledge that glossing difference is fundamental to the function of and the authorizing power of public, as it is marshalled by speakers. By analogizing Perelman and Olbrechts-Tyteca's universal audience with public, this paper (a) introduces the public metonym, a rhetorically productive counterfactual totality that glosses the material particularities of social groups, (b) critiques the particularist approach to the paradox of public, (c) introduces the resistance metonym as a rhetorically-minded alternative, and (d) clarifies distinctions among projects that claim to address a common object called pUblic. This book addresses the problem of how to make democratically-legitimate public policy on issues of contentious bioethical debate. It focuses on ethical contests about research and their legitimate resolution, while addressing questions of political legitimacy. How should states make public policy on issues where there is ethical disagreement, not only about appropriate outcomes, but even what values are at stake? What constitutes justified, democratic policy in such conflicted domains? Case studies from Canada and Australia demonstrate that two countries sharing historical (...) and institutional characteristics can reach different policy responses. The Noctes Atticae, written by Aulus Gellius in the mid-second century, is a collection of short chapters dealing with a great variety of topics including philosophy, history, law, grammar, and literary criticism. In this reissue there is a complete re-examination of the codices, the first since the nineteenth-century.

Aulus Gellius, who lived in Rome un the mid-second century AD, wrote his Noctes Atticae in twenty books; of this most survives and only lacks the beginning, end, and all of book 8 bar the chapter headings. The work is a collection of end, and all of book 8 bar the chapter headings. The work is a collection of mainly short chapters dealing with a great variety of topics including philosphy, history, law, grammar, and literary criticism. Gellius began collecting the (...) material while a student in Athens, and assembled it later in life with the specific purpose of entertaining and instructing his own children.The manuscripts of Gellius have not been examined since the middle of the nineteenth century. this new edition presents a complete reexamination of the codices, several of which are earlier than previous editors have thought. Full collations are provided for numerous fragmentary citations in the text, in the hope that they will allow a more accurate treatment of these fragments. In Books 9-20 the readings of the newly discovered ninth century manuscript F are presented, on the basis of which the editor attempts to offer a new criterion for deciding between variant readings. Drawing on William F. Ogburn's cultural lag thesis, an inherent conflict is proposed between the rapid speed of modern technological advances and the slower speed by which ethical guidelines for utilization of new technologies are developed. Ogburn's cultural lag thesis proposes that material culture advances more rapidly than non-material culture. Technology is viewed as part of material culture and ethical guidelines for technology utilization are viewed as an adaptive aspect of non-material culture. Cultural lag is seen as a critical ethical (...) issue because failure to develop broad social consensus on appropriate applications of modern technology may lead to breakdowns in social solidarity and the rise of social conflict. Reasons for cultural lag between technology and ethics include the social structural and market conditions under which each are developed. The thesis is illustrated by reviews of technological trends involving computer-telecommunications electronics and bio- genetic engineering, and the implications of these and other technologies for privacy rights, electronic commerce, control of essential resources and social definitions of life are discussed. This article is the lead piece in a special report that presents the results of a bioethical investigation into chimeric research, which involves the insertion of human cells into nonhuman animals and nonhuman animal embryos, including into their brains. Rapid scientific developments in this field may advance knowledge and could lead to new therapies for humans. They also reveal the conceptual, ethical, and procedural limitations of existing ethics guidance for human‐nonhuman chimeric research. Led by bioethics researchers working closely with an (...) interdisciplinary work group, the investigation focused on generating conceptual clarity and identifying improvements to governance approaches, with the goal of helping scholars, funders, scientists, institutional leaders, and oversight bodies (embryonic stem cell research oversight [ESCRO] committees and institutional animal care and use committees [IACUCs]) deliver principled and trustworthy oversight of this area of science. The article, which focuses on human‐nonhuman animal chimeric research that is stem cell based, identifies key ethical issues in and offers ten recommendations regarding the ethics and oversight of this research. Turning from bioethics’ previous focus on human‐centered questions about the ethics of “humanization” and this research's potential impact on concepts like human dignity, this article emphasizes the importance of nonhuman animal welfare concerns in chimeric research and argues for less‐siloed governance and oversight and more‐comprehensive public communication. Each Local Research Ethics Committee (LREC) is expected to produce an annual report for its establishing authority. Reports from 145 LRECs were examined with regard to (a) whether the committees were working within the terms of the most recent guidelines from the Department of Health and (b) observations on the role of LRECs with particular reference to accountability. Most LRECs had produced a report, although their length varied greatly. Most reports showed how seriously the committee took its task. Most committees (...) met many of the guidelines; for example, almost all had two or more lay-members. The guideline most frequently not met was that committees should have no more than 12 members. Many committees review very large numbers of projects (maximum 351). Approximately two-thirds provide details in the annual report of individual project titles, their author and the committee decision; all reports should contain this information. Although it may in fact happen more generally, only 23 per cent of the reports referred to any form of monitoring of the eventual outcome of the research. A significant issue to arise from the reports is the extent to which the framework for the operation of LRECs has been confused by the development of the purchaser-provider split. The use of nonhuman animals in research has long been a source of bioethical and scientific debate. We consider the oversight and use of nonhuman animals in chimeric research. We conducted interviews with twelve members of embryonic stem cell research oversight committees, nine members of institutional animal care and use committees, and fourteen scientists involved in human–nonhuman‐animal chimeric research in different areas of the United States. Interviews addressed animal welfare and conceptual issues associated with moral status and humanization of nonhuman (...) animals that contain human cells. Our findings suggest that concepts of enhanced moral status and consciousness are not very useful in human–nonhuman‐animal chimeric research in part because their meanings are not easily defined, which presents challenges to applying the concepts in research. Instead, scientists and oversight committee members we interviewed seemed to rely on standard assessments of changes in animal welfare when focusing on the ethics of human‐animal chimeric research. All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

This paper presents Integrated Information Theory (IIT) 4.0. IIT aims to account for the properties of experience in physical (operational) terms. It identifies the essential properties of experience (axioms), infers the necessary and sufficient properties that its substrate must satisfy (postulates), and expresses them in mathematical terms. In principle, the postulates can be applied to any system of units in a state to determine whether it is conscious, to what degree, and in what way. IIT offers a parsimonious explanation of (...) empirical evidence, makes testable predictions, and permits inferences and extrapolations. IIT 4.0 incorporates several developments of the past ten years, including a more accurate translation of axioms into postulates and mathematical expressions, the introduction of a unique measure of intrinsic information that is consistent with the postulates, and an explicit assessment of causal relations. By fully unfolding a system's irreducible cause-effect power, the distinctions and relations specified by a substrate can account for the quality of experience. (shrink)

The target article misrepresents the foundations of integrated information theory and ignores many essential publications. It, thus, falls to this lead commentary to outline the axioms and postulates of IIT and correct major misconceptions. The commentary also explains why IIT starts from phenomenology and why it predicts that only select physical substrates can support consciousness. Finally, it highlights that IIT's account of experience – a cause–effect structure quantified by integrated information – has nothing to do with “information transfer.”.

The present study applies a new method for investigating dynamic unconscious processes. The method consists of selection of words from patient interview and test protocols that in the clinicians' judgments capture the patients' conscious symptom experience and the hypothetical unconscious conflict related to the symptom, subliminal and supraliminal presentation of these words, signal analysis of event-related potentials obtained to the word presentations. Eight phobics and three patients suffering from pathological grief reactions served as subjects. A time-frequency ERP analysis revealed that (...) subjects' ERPs classified the unconscious conflict words better subliminally than supraliminally, while the reverse was true for the conscious symptom words = 2.82, p = .011). The relationship between frequency and latency revealed a similar mirror image pattern for the unconscious conflict and conscious symptom words . This method demonstrated that objective, brain-based evidence for unconscious conflict can be obtained. (shrink)

Some time ago, F. P. Ramsey (1960) suggested that knowledge is true belief obtained by a reliable process. This suggestion has only recently begun to attract serious attention. In 'Discrimination and Perceptual Knowledge', Alvin Goldman (1976) argues that a person has knowl- edge only if that person's belief has been formed as a result of a reliable cognitive mechanism. In Belief, Truth, and Knowledge, David Arm- strong (1973) argues that one has knowledge only if one's belief is a comPletely reliable (...) sign of the truth of the proposition believed. On both of these theories, the reliability of one's belief is a necessary condition of that belief's being an instance of knowledge. These reliability theories have another interesting feature in common, namely, that neither of them explicitly requires or includes the traditional justification requirement for knowledge. Reliability has taken over the role of justification. This naturally leads to the question whether reliability and justification are related in some philosophically interes- ting fashion. In this paper I shall investigate this question. The result will be a positive proposal to the effect that justified belief is reliable belief. This result, in turn, explains why reliability can take over the role of justification in an account of knowledge. Moreover, the identification of justification with reliability constitutes a step toward the naturalization of normative epistemological concepts. (shrink)

This research examines how the fit between employees moral development and the ethical work climate of their organization affects employee attitudes. Person-organization fit was assessed by matching individuals' level of cognitive moral development with the ethical climate of their organization. The influence of P-O fit on employee attitudes was assessed using a sample of 304 individuals from 73 organizations. In general, the findings support our predictions that fit between personal and organizational ethics is related to higher levels of commitment and (...) job satisfaction and lower levels of turnover intent. Ethical P-O fit was related to higher levels of affective commitment across all three ethical climate types. Job satisfaction was only associated with ethical P-O fit for one of the three P-O fit variables and turnover intentions were significantly associated with two of the ethical P-O fit variables. The most consistent effect was found for the Conventional - Caring fit variable, which was significantly related to all three attitudes assessed. The weakest effect was found for the Preconventional - Instrumental fit variable, which was only predictive of affective commitment. The pattern of findings and implications for practice and future research are discussed. (shrink)

BackgroundThere is evidence that direct journal endorsement of reporting guidelines can lead to important improvements in the quality and reliability of the published research. However, over the last 20 years, there has been a proliferation of reporting guidelines for different study designs, making it impractical for a journal to explicitly endorse them all. The objective of this study was to investigate whether a decision tree tool made available during the submission process facilitates author identification of the relevant reporting guideline.MethodsThis was (...) a prospective 14-week before–after study across four speciality medical research journals. During the submission process, authors were prompted to follow the relevant reporting guideline from the EQUATOR Network and asked to confirm that they followed the guideline (‘before’). After 7 weeks, this prompt was updated to include a direct link to the decision-tree tool and an additional prompt for those authors who stated that ‘no guidelines were applicable’ (‘after’). For each article submitted, the authors’ response, what guideline they followed (if any) and what reporting guideline they should have followed (including none relevant) were recorded.ResultsOverall, 590 manuscripts were included in this analysis—300 in the before cohort and 290 in the after. There were relevant reporting guidelines for 75% of manuscripts in each group; STROBE was the most commonly applicable reporting guideline, relevant for 35% (n = 106) and 37% (n = 106) of manuscripts, respectively. Use of the tool was associated with an 8.4% improvement in the number of authors correctly identifying the relevant reporting guideline for their study (p < 0.0001), a 14% reduction in the number of authors incorrectly stating that there were no relevant reporting guidelines (p < 0.0001), and a 1.7% reduction in authors choosing a guideline (p = 0.10). However, the ‘after’ cohort also saw a significant increase in the number of authors stating that there were relevant reporting guidelines for their study, but not specifying which (34 vs 29%; p = 0.04).ConclusionThis study suggests that use of a decision-tree tool during submission of a manuscript is associated with improved author identification of the relevant reporting guidelines for their study type; however, the majority of authors still failed to correctly identify the relevant guidelines. One of the most important pieces of evidence which we possess concerning the judicial rights of Roman provincials, particularly their status in relation to the governor's tribunal, is provided by Cicero's brief outline of those provisions of the lex Rupilia, the Sicilian provincial charter, which dealt with judicial administration. The passage reads as follows: Siculi hoc iure sunt ut, quod civis cum cive agat, domi certet suis legibus, quod Siculus cum Siculo non eiusdem civitatis, ut de eo praetor iudices ex (...) P. In general, there are two ways to approach cognition. One is to start with the features of the human case and try to generalize to other species. Another is to start with the biological conditions under which natural cognition evolved and currently operates and ask what organisms do such that they might require cognition. A full account of cognition requires both. Cognitive biology, however, requires a biogenic approach. Tight integration with biological knowledge places strong constraints on cognitive explanation. These constraints (...) arise from the fact that cognition evolved in a particular context with very special features. All organisms are complex, self-organizing, dynamical systems that exist far from thermodynamic equilibrium and actively maintain themselves in this statistically improbable state by continuously manufacturing the components of the processes that sustain them. Organisms thus must interact with the world in ways that allow them to actively secure matter and energy. They are also persistence-valuing systems: most organisms have mechanisms for resisting or avoiding perturbations that threaten their integrity. A biogenic approach thus stresses the role of mechanisms that facilitate system persistence, for example, those that integrate information concerning external and internal states of affairs to facilitate adaptive behaviour; differentiate some states of affairs from others; invest different properties of the environment with different degrees of salience; appraise system needs relative to prevailing conditions, the potential for interaction, and whether the current interaction is succeeding ; and reduce the impact of random perturbations on system functioning, of which there are many, potentially lethal sources. These are recognisably cognitive functions. Mounting evidence suggests that even bacteria grapple with problems long familiar to cognitive scientists, including: integrating information from multiple sensory channels to marshal an effective response to fluctuating conditions; making decisions under conditions of uncertainty; communicating with conspecifics and others ; and coordinating collective behaviour to increase the chances of survival. Thus a biogenic approach not only justifies the use of very simple biological models to study cognition, it suggests that this is precisely where we ought to look to ascertain the general logic of the function, as well as the mechanisms that carry it out. We use Homer and Sun Tzu as a background to better understand and reformulate confrontation, anger and violence in medicine, contrasting an unproductive ‘love of war’ with a productive ‘art of war’ or ‘art of strategy’. At first glance, it is a paradox that the healing art is not pacific, but riddled with militaristic language and practices. On closer inspection, we find good reasons for this cultural paradox yet regret its presence. Drawing on insights from Homer's The Iliad and The (...) Odyssey, we argue for better understanding of confrontation, anger, bullying, intimidation and violence in medicine in order to change the culture. For example, equating medicine with war is not a given condition of medicine but a convenient metaphor with historical origins and a historical trajectory. Other, non-martial metaphors, such as medicine as collaboration, may be more appropriate in an age of team-based care. Taking lessons from Homer, we suggest three key ways in which cold-hearted confrontation and anger in medicine can be transformed into productive, warm-hearted engagement: the transformation of angry impulse into reflection, moral courage and empathy. Thinking with Homer can offer an aesthetically and morally charged alternative to the current body of literature on topics, such as anger in doctors, and how this may be ‘managed’, without recourse to an instrumental economy where emotions are viewed as commodities, and emotional responses can be ‘trained’ through communication skills courses. This would be admirably clear and would give excellent sense, but it does entail the deletion of as an interpolation before Marshall is aware that is a word that is not likely to be used by an interpolator, but still feels able to propose its deletion and gives a detailed account of the way in which an interpolator might have approached the sentence. When one attempts to read the mind of an ancient scribe, all sorts of possibilities are opened (...) up; in this instance, it seems equally possible that a reader who, as Marshall suggests, was faced with … and was not able to understand the sentence because he failed to separate from and to see that was to be taken in the second clause, would have been inclined first at least to see whether sense could be obtained by separating from rather than to conjure up the word. This essay grows out of the conviction that recent work by psychologists studying human reasoning has important implications for a broad range of philosophical issues. To illustrate our thesis we focus on Nelson Goodman's elegant and influential attempt to "dissolve" the problem of induction. In the first section of the paper we sketch Goodman's account of what it is for a rule of inference to be justified. We then marshal empirical evidence indicating that, on Goodman's account of justification, patently invalid (...) inferential rules turn out to be "justified." We conclude that something is seriously wrong with Goodman's story about justification. In the second section we attempt to patch Goodman's account. The notion of epistemic authority and the social aspect of justification play central roles in the alternative account of justification that we propose. (shrink)

The conflict in Gaza and Israel that ignited on October 7, 2023 signals a catastrophic breakdown in the possibility of ethical dialogue in the region. The actions on both sides have revealed a dissolution of ethical restraints, with unimaginably cruel attacks on civilians, murder of children, destruction of health facilities, and denial of basic needs such as water, food, and shelter. There is a need both to understand the nature of the ethical singularity represented by this conflict and what, if (...) any, options are available to allow the reconstruction of communication between the warring parties. This article seeks to address these tasks by analysing the conflict as inherently an ethical one, in the sense that it exposes a rupture in the fabric of communicative relationships that has evolved systematically out of the deep cultural structures from which all protagonists have emerged. Drawing on the work of Levinas, Habermas, Arendt, and others, and referring to the specific circumstances in the region, it examines the ethical sources of the crisis and tries to identify conditions for its resolution. The possibility of reconciliation—that is, of refiguring relationships to open up a space for dialogue to create pathways to heal the ruptures—is examined. The dark legacy of the Holocaust is identified as an abiding cultural vulnerability for both societies. It is concluded, however, that the rich history of partnerships and collaborations between Jews and Palestinians provides a robust infrastructure on the basis of which a sustainable peace might be built, providing a much-needed source of hope.
